This disclaimer sets out the terms and conditions that apply to the T-shirt Days campaign (the “Campaign”) organized by TVH Parts Holding NV, with registered office at Brabantstraat 15, 8790 Waregem, Belgium and with VAT number 0425.399.042, on behalf of itself and all of its affiliates (“TVH”).
By participating in the Campaign, the customer accepts, without reservation or restriction, all provisions of this Disclaimer and the decisions of TVH. The customer additionally recognizes that all purchases are subject to the General Terms and Conditions of Sale, as available on this website: https://www.tvh.com/terms-conditions (for TVH customers) or https://www.bepcoparts.com/en-be/terms-conditions (for Bepco customers).
Customers can receive a T-shirt (as described below) (the “Gift”) by placing an order via one of TVH's webshops for a minimum purchase amount as set out in Table A below. The minimum purchase amount can be spread over multiple orders to receive the Gift.
The Gifts are attributed to the customers on a “first come, first served” basis and as long as stock lasts. The number of Gifts available per region is specified in Table B below. Depending on their total purchase amount, customers can receive up to a maximum of five (5) Gifts in total per customer number.
The Campaign is only valid on new orders placed by customers via one of TVH's webshops as from Monday 6 November 2023 at 00:00 until Friday 10 November 2023 at 24:00 (CET / GMT +1) or as long as the stock of the Gift lasts.
TVH shall make every effort to allow access to its webshops at any time. However, TVH may interrupt access to one of its webshops at any time, in particular for technical reasons, updates and maintenance. Under no circumstances can TVH be held liable for these interruptions and their consequences.
The Gift that customers will receive consists of a limited edition T-shirt with a TVH design. Images of the Gift published by TVH are for reference purposes only. The Gift, the one the customers will actually receive, might look slightly different.
It is not allowed for the customer to transfer (including any sale) the Gift to any other person or company. The Gift may not be exchanged or converted into cash in any way whatsoever through any channel.
TVH shall ensure that the Gift is sent to the customer–if the customer has ordered products for a minimum purchase value as set out in Table A below, and if the customer has provided sufficient, complete and correct contact details in the form – within six (6) months after the end date of the Campaign (cf. article 4).
TVH cannot be held responsible or liable for (i) not being able to deliver a Gift if the customer provided insufficient, incomplete or incorrect contact details; (ii) possible damage, physical injury or accidents that could occur as a result of receiving the Gift, (iii) any shortcomings of the post and/or courier companies when delivering the Gift (such as delay, damage, strike or loss); (iv) unexpected costs; (v) any defect in the Gift or if it doesn't meet the created expectations; (vi) possible accidents or damage (in)directly related to a Gift received.
