Lights contest: competition rules
Article 1: Principle
These competition rules set out the regulations governing the conditions of participation in the non-mandatory competition to win the prizes mentioned in Article 5. (hereinafter the "Lights Contest").
This Lights Contest is organised by TVH Parts NV, with registered office at Brabantstraat 15, 8790 Waregem, Belgium (hereinafter the "Organiser").
By participating in the Lights Contest, the Participant (as defined below) accepts without reservation or restriction all provisions of these competition rules and the decisions of the Organiser.
Article 2: Who can participate?
Participation in the Lights Contest with purchase obligation is exclusively reserved for organisations with a ABN; except for those based in Turkey, Sweden or in North or South America. (hereinafter the "Participant")
The natural person placing the order is not personally eligible for a prize.
Article 3: Modalities of participation
The Participant will receive a "ticket"/"opportunity" to participate in the Lights Contest (hereinafter a "Ticket"), if the Participant:
- registers on the website [*],
- answers the knowledge question correctly, and
- fills in the tie-breaker question.
In order to validly register, the Participant must fill in the following data: contact title, last name, first name, company name, ABN, function, registered address of the company, postal code, municipality, country, telephone, e-mail and language.
In light of the possible prize the Participant must during its registration also provide the number of persons/employees active at/employed by the Participant (= the number of persons who would “benefit” from the prize).
The Participant guarantees that the communicated data and information is correct, up to date and complete.
Any incomplete participation and any participation that has not been submitted via the mentioned website will be declared null and void.
The activation of the Ticket (and the effective participation in the Lights Contest) is done by the purchase of lights from one of the following categories: 2110100 Rear light - 2110200 Frontlight - 2110101 Indicator light - 2110202 Marker lamp - 2110900 Number plate light -
2110201 Worklight - 2111200 Light bar - 2111100 Led strip light - 2110203 Projection warning light - 2110300 Rotating/flashing beacon; via the webshop MyTotalSource or by telephone via the Organiser's sales service for an aggregate value of at least TWO HUNDRED EURO (€ 200, 00*) excl. GST over the time period of the Lights Contest (as mentioned in art. 4).
Each Participant can only obtain one (1) Ticket and, if applicable, activate it.
Participants that over the time period of the Lights Contest (as mentioned in art. 4) purchased lights (from the categories as mentioned here above) for an amount:
- over FIVE HUNDRED EURO (€ 500, 00*) excl. GST, will have the chance to win a prize in category 1, 2 and 3; hence such Participant has three (3) chances to win a prize. (starting from category 3, being the category of the main prize)
- over FOUR HUNDRED EURO (€ 400, 00*) excl. GST but below FIVE HUNDRED EURO (€ 500, 00*) excl. GST, will have the chance to win a prize in category 1 and 2; hence such Participant has two (2) chances to win a prize. (starting from category 2 being the category of the second prize)
- over TWO HUNDRED EURO (€ 200, 00*) excl. GST but below FOUR HUNDRED EURO (€ 400, 00*) excl. GST, will only have the chance to win a prize in category 1; hence such Participant has only one (1) chance to win a prize.
* Or these amounts converted into one of the following currencies: GBP, ZAR, PLN, RUB, USD, AUD, NZD, SGD, MYR (total amount excluding GST) - 5/01/2021
In the event that not all the conditions of the competition rules are met or in the event of abuse, deception, fraud or bad faith, the Organiser reserves the right to exclude the Participant in question from the Lights Contest.
Article 4: Time period
The Lights Contest starts on Monday 1 February 2021 at 00:00 and ends on Friday 30 April 2021 at 24:00. (CET / GMT+1)
Both obtaining a Ticket and its activation must take place within this period.
Article 5: The Prize
Participants who have activated their Ticket(s) have a chance to win one of the following prizes:
- Category 1 – “one star party”: Voucher for a party at the rate of FIFTEEN EURO (€ 15,00*) excl. GST per person with as total maximum amount for the “one star” party ONE THOUSAND FIVE HUNDRED EURO (€ 1.500,00*) excl. GST
- Category 2 – “two star party”: Voucher for a party at the rate of TWENTY-FIVE EURO (€ 25,00*) excl. GST per person with as total maximum amount for the “two star” party THREE THOUSAND EURO (€ 3.000,00*) excl. GST
- Category 3 – “three star party”: Voucher for a party at the rate of FORTY-FIVE EURO (€ 45,00*) excl. GST per person with as total maximum amount for the “three star” party SIX THOUSAND FIVE HUNDRED EURO (€ 6.500,00*) excl. GST
* Or these amounts converted into one of the following currencies: GBP, ZAR, PLN, RUB, USD, AUD, NZD, SGD, MYR (total amount excluding GST) - 5/01/2021
General conditions/restrictions with respect to the prize:
- A Participant can win a maximum of one prize in this Lights Contest.
- The prize may not be exchanged into gifts/cash or converted into cash in any way whatsoever through any channel.
- A prize can only be awarded to the winner of the Lights Contest and is therefore not transferable (including any sale) to any other person.
- Each prize awarded is valid for a period of one (1) year starting from May 1st, 2021. After the date of April 30th 2022, the prize won becomes expired; hence can no longer be claimed from the Organizer. Note: the expiry date will be suspended in accordance with any local, regional or national governmental restrictions preventing the prize to be claimed and consumed due to the pandemic caused by COVID-19.
Special conditions/restrictions with respect to the prize:
- No alcohol, drugs or any other illegal substances shall be allowed to be ordered when organizing the prize/party
- The prize/party needs to take place in a professional setting/environment and hence cannot consist out of a hospitality event
- The registered address mentioned in the participation form is the location where the party will take place (unless mutually agreed upon otherwise)
- The party is limited to the employees located/active at the address mentioned in the participation form
- The Organizer shall be entitled to verify the number of employees (mentioned in the participation form) of the winning Participant
Hand-over of the prize/process of ”Organizing the Party”:
- Each winner will be contacted by the Organiser (via e-mail or telephone) to arrange how and when the prize will be handed over / organized. Note: all arrangements in light of the handover of the prize need to be in line with all local, regional and national governmental regulations in light of the pandemic caused by COVID-19.
- The Organizer and winning Participant shall agree on the choice of 'caterer/food truck/ butcher/etc.' and composition of package within the value of the prize won
- The Organizer shall subsequently place the order with the chosen caterer/.... for the party and give clear instructions on what type of information needs to be mentioned on the relevant invoice from the 'caterer/food truck/ butcher/etc.'
- The invoice from the 'caterer/food truck/ butcher/etc.' with respect to the party shall be addressed to and paid by the Organizer
When requested, the Organizer can provide the chosen caterer with some TVH promo material (e.g. TVH flags, TVH napkins, etc.)
Article 6: Determination and announcement of winners
In total there will be three (3) winners.
A winner is a Participant who, within the period specified in Article 4, cumulatively meets all the conditions of the Lights Contest, that is:
- The Participant must have correctly registered on the web page of the Lights Contest by filling in his/her details and the requested mandatory information.
- The Participant must have answered the knowledge question correctly and as soon as possible and have answered the tie-breaker question correctly.
- The Participant has purchased lights from one of the following categories: 2110100 Rear light - 2110200 Frontlight - 2110101 Indicator light - 2110202 Marker lamp - 2110900 Number plate light - 2110201 Worklight (aka beacons) - 2111200 Light bar - 2111100 Led strip light - 2110203 Projection warning light - 2110300 Rotating/flashing beacon; via the webshop MyTotalSource or by telephone via the Organiser's sales service for an aggregate value of at least TWO HUNDRED EURO ( € 200, 00) excl. GST over the time period of the Lights Contest (as mentioned in art. 4)
If no one answered the tie-breaker question correctly, the 3 (or remaining) winners will be the Participants who answered the knowledge question correctly and whose answer to the tie-breaker question is closest to the correct answer.
The winner will in all events be appointed taking into consideration the aggregate amount of lights purchased; hence the number of chances to win a prize and the category to win a prize in. (see article 3)
Mechanism of appointment of the three winners: first appointment winner category 3 prize, secondly appointment winner category 2 prize and finally appointment winner category 1 prize.
In case of a possible ex aequo, the Participant who has bought the most lights within the period mentioned in article 4, will be the winner.
The winners will be contacted personally by the Organiser via e-mail or telephone no later than 14 May 2021. The winners will also be announced via the Organiser's Facebook and LinkedIn page if applicable.
The result of the Lights Contest is binding and irrevocable. The decision to designate winners is therefore final and cannot be contested.
Article 7: Liability
The Organiser cannot be held responsible or liable for:
- not being able to deliver a prize if the Participant provided insufficient, incomplete or incorrect contact details.
- possible damage, physical injury or accidents that could occur as a result of winning a prize and/or participating in the Lights Contest.
- any shortcomings of the post and/or courier companies when delivering a prize (such as delay, damage, strike or loss).
- any defect in the prize or if the prize doesn't meet the created expectations.
- possible accidents or damage (in)directly related to a prize won.
The Organiser shall make every effort to allow access to the website and the Lights Contest at any time. The Organiser may interrupt access to the website and the Lights Contest at any time, in particular for technical reasons, updates and maintenance. Under no circumstances can the company be held liable for these interruptions and their consequences.
Article 8: Amendments to regulations
The Organiser reserves the right to modify, suspend or revoke the Lights Contest or its course at any time in any individual jurisdiction, if it is compelled to do so for legal reasons or if unforeseen circumstances or circumstances independent of the Organiser's wish justify this, without any right to compensation or indemnification in respect of the Participants.
If amendments to the regulations are made, these will be communicated to the Participants by email.
Article 9: Applicable law & disputes
These regulations are subject to Belgian law and will be implemented and interpreted in accordance with Belgian law.
The Organiser will see to the proper course of the Lights Contest. All disputes concerning the application of these regulations shall be settled autonomously by the Organiser.
Article 10: Privacy
All personal data communicated by the Participants in connection with or within the framework of the Lights Contest will be stored in a database managed by the Organiser. This personal data of the participants is thus processed by the Organiser.
This data falls under the application of the law of 30 July 2018 on the protection of individuals with regard to the processing of personal data and all Belgian regulations implementing the GDPR. The Organiser wishes to guarantee the private life of the Participant in compliance with all legal or other provisions relating to the protection of private life.
By participating, Participants agree that if they win a prize, they may appear on the website and other channels (such as YouTube, Facebook ...) with their picture, name and address, as well as on the website and online channels of any co-organisers, and in the written press, as well as be filmed for (television) coverage of the Lights Contest.
This data can also be used for promotional campaigns or discounts, for information and for studies.
You may at any time consult the personal data processed by the Organiser, have all necessary corrections made or ask the Organiser, free of charge, to remove them from its files or not to communicate all or part of the information obtained to third parties.
